Heard the learned counsel for the petitioner. The only grievance of the petitioner is the petitioner submitted an application in response to an advertisement for awarding the retail outlet (petrol-pump) dealership at village Suregaon, Taluka Newasa, District Ahmednagar. The learned counsel then submitted that on 12.01.2015 a communication was forwarded to the petitioner informing him that the demand draft submitted by him is not acceptable and the petitioner was granted liberty to re-submit the Demand Draft on or before 02.02.2015. In response to this communication, the petitioner on 02.02.2015 submitted the fresh Demand Draft.
WP.8132-17.odt The copy of the application by the petitioner along with the copy of the Demand Draft is placed on record. There was no further order passed by Respondent No.2 till date, as such, the petitioner is before this Court.

The learned counsel Mr. Kulkarni who appears for Respondent No.2, on instructions, submitted before us that a decision is already taken by Respondent No.2 and the application submitted by the petitioner. The claim of the petitioner by way of an application submitted to Respondent No.2 is rejected and the petitioner may avail an appropriate remedies to challenge the rejection order.

In view of this statement, the learned counsel for the petitioner prayed for withdrawal of petition with liberty to challenge the order passed by Respondent No.2. 4.
The petition is allowed to withdraw with liberty as prayed for.
