The present matter has been settled between the parties out of the Court. The terms of settlement are incorporated in the present application. Shri. Patnoorkar the learned Counsel appearing for the Original claimants submits that, the claimants have received the amount of compensation as agreed, from the owner of the vehicle. In view of the submissions so made, the civil application stands disposed of in terms of prayer clause 'B' since the parties have compromised the matter out of the Court.
In view of disposal of First Appeal, nothing survives for consideration in the Civil Application No. 7054 of 2002 and same stands disposed of.
