In both petitions, petitioners want to add their names in the list of transfer. Their contention is that unless they have been listed in the list of the employees due for admission, they would not be entitled to apply for the upcoming transfers online.

Learned Counsel for respondent nos. 2 to 4 has the specific instructions that if the candidates want to apply in category-I, they may directly apply online. Then concerned Officer would display the list thereafter, if they are eligible then they may be considered. 4.

Learned Counsel for the petitioners is satisfied with the submission made on behalf of respondent nos. 2 to 4. Hence we, dispose of both the petitions by leave the petitioners to apply online for transfer in special category part - I. After applying online, respondent nos. 2 to 4 shall consider their applications strictly as per the law.

While considering the claim of the petitioners, respondent nos. 2 to 4 should bear in mind the judgment passed by the High Court of Bombay, Bench at Nagpur in the matter of Sachin Subhashrao Tambhakhe and Others Vs.
