CORAM

:

R.G.AVACHAT AND NEERAJ P. DHOTE, JJ.

DATE :

JULY 30, 2025 ORDER :- Heard learned counsel for the petitioners and learned AGP for respondent no.1.

2.

The petitioners are working as non-teaching staff in the respondent - school. They claim entitlement for Assured Career Progress Scheme (ACPS). Their representations were forwarded by the Headmaster of their school to the Education Officer (Primary), Zilla Parishad, Latur. In the meanwhile, similar issue was considered

and decided by this Court in a bunch of Writ Petitions, one of which is Writ Petition No.2358 of 2013 decided on 21.09.2013. The petitioners approached this Court since no decision has been taken by the respondents in respect of grant of A.C.P.S. 3.

On 26.06.2025, it was informed by learned AGP that the issue involved is covered by the Government Resolution dated 14.03.2024, issued by the School Education and Sports Department Government of Maharashtra; and the learned counsel for the petitioners had sought time to go through the said Government Resolution and make submissions.

4.

Today, learned counsel for the petitioners agrees that the petitioners will make detailed/comprehensive representations to the Education Officer (Primary), Zilla Parishad, Latur, on the basis of the aforesaid Government Resolution and the decision of this Court; and prays that necessary directions be given to consider the same within a stipulated time.

5.

Considering the above aspect, we dispose of the Writ Petitions with liberty to the petitioners to file their detailed/comprehensive representations before the competent authority. If such representations are filed, the competent authority

shall consider the same on their own merits, in the light of the above Government Resolution and the decision of this Court, within a period of six months from the date of submitting the representation. [NEERAJ P. DHOTE, J.] [R.G. AVACHAT, J.] KBP
