This Misc. Civil Application filed by the applicant wife, seeking transfer of H.M.P. Petition No.105/2019, filed by the respondent/husband at Osmanabad deserves to be allowed, in the wake of the submission advanced by the learned Counsel Ms. Bhosale, appearing for respondent/wife to the effect that at present, the respondent husband is residing in Mumbai and he is also serving in Mumbai. She categorically state that the proceedings came to be filed in Osmanabad, since at the relevant time, he was residing in Osmanabad. However, in the wake of subsequent development, now he is residing in Mumbai. She has no objection if H.M.P. No.105/2019 filed by respondent/husband in the Court of learned Civil Judge Senior Division, Osmanabad is
276.19mca (2) transferred to the Family Court, Aurangabad. Pertinent to note that the wife is serving as P.S.I in Aurangabad and it is more convenient to her to attend the said proceedings in Aurangabad. 2.
On the H.M.P. No.105/2019 being transferred to the Family Court, Aurangabad, the Family Court, Aurangabad is requested to expedite the proceedings and shall make every endeavour to conclude the same within a period of one years from today. The Family Court shall also not insist upon personal presence of respondent/husband on every date of hearing and shall exempt his attendance unless when it is extremely necessary for the purpose of recording evidence. The Misc. Civil Application stands disposed of.
