The applicant apprehends arrest in connection with Crime No.933 of 2023 registered with MIDC Waluj Police Station, District Auranagabad for offences punishable under sections 306, 323, 504, 506 read with section 34 of the Indian Penal Code.

Informant - mother of deceased Devika lodged FIR alleging that marriage of her daughter Devika was performed with Lakhan on 08.05.2021. Devika was residing in joint family with her in-laws. Initially, for two years Devika was treated well. Two months prior to the date of incident, Devika called
informant and informed that she has seen her husband and applicant in compromising position. Thereafter, all the inlaws started ill-treating her. On 06.11.2023, a call was received on cellphone of informant's husband that Devika has committed suicide. Thereafter, the present FIR is lodged. 3.
Heard learned advocate for applicant and learned APP for respondent - State. Perused the papers of investigation.

FIR is lodged on 07.11.2023. Lakhan - husband of Devika was arrested and released on bail. Other in-laws are released on anticipatory bail. It is alleged in FIR that Lakhan had illicit relations with applicant, which were seen by deceased Devika.

Considering gender of applicant and allegations against her, nothing is to be recovered from her. Investigation appears to be almost complete, and therefore, pre-trial custodial detention of the applicant is not necessary. 6.
The application is therefore allowed by confirming interim protection granted to applicant on 24.11.2023.

Till filing of charge-sheet, applicant shall attend the concerned police station as and when called by Investigating Officer. Applicant shall not tamper the prosecution evidence. [ NITIN B. SURYAWANSHI ] JUDGE S.P. Rane
