IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD MISC. CIVIL APPLICATION NO.2 OF 2017 Sau. Shital Sandip Kokate, Age : 28 years, Occu. Household, R/o c/o Sahebrao Shrirangrao Barhate, R/o Vidyanagar, Opp. Dnyaneshwar Temple, Parbhani, Dist. Parbhani ..APPLICANT

VERSUS

Sandip s/o Babasaheb Kokate, Age : 31 years, Occu. Service, R/o C/o Shri Bandu Krushna Ghodke, Survey No.7/2/2/2, Tuljai Pathar, Saidattanagar, Dhankwadi, Pune, Dist. Pune-411 043 ..RESPONDENT Mr D.B. Kale, Advocate for applicant;

Mr V.M. Mane, Advocate for respondent CORAM : N.W. SAMBRE, J.

DATE : 23rd June, 2017 ORAL ORDER The application for transfer of proceedings is opposed on the ground that the applicant's real brother is residing at Pune and as such, she can conveniently attend the proceedings.

2.

In my opinion, the application needs to be allowed in terms of prayer clause (B), for the reason that distance between Parbhani and Pune is almost 500 Kms. and there is no proper connectivity so as to feel it convenient to travel without an attendant to Pune.

mca2.17 (2) 3.

The applicant is residing with her parents at Parbhani and in response to an offer as to how much amount the respondent is ready and willing to pay her towards travel and other expenses, the respondent is seeking adjournment on the said ground.

4.

Hence, Misc. Civil Application stands allowed in terms of prayer clause (B).
