The learned counsel for the petitioner submits that time to time representations are made to the respondent No. 4 for removal of encroachment. According to the petitioner, the encroachment is in the property of Wakf. The petitioner claims to be Mutawali. 2.

The petitioner has remedy to approach Wakf Tribunal under the provisions of the Wakf Act.

The petitioner may also prosecute application filed by the petitioner before the respondent No. 4 as may be permissible under law. If said application is filed, naturally, the authority will have to consider the same on its own merits.
