Heard both the sides finally.

The petitioner's grievance is about non receipt of pension under the provisions of the Employees Pension Scheme, 1995. 3.
After hearing both sides, it transpires that the respondent No. 9 is unable to process the papers of the petitioner for want of form No. 10-D and due to insufficient details in respect of his service when he was posted in Palghar Division from 16 April 1983 to 29 August 1983.

Learned advocate for the petitioner, on instructions from
2 wp 14490.19 his client makes a statement that the petitioner is ready to forgo the disputed period. He also makes statement that though the Form No. 10-D has already been forwarded, if it is case of the respondent No. 9 that it is not in receipt of that form, a copy of it would be made available.

Learned advocate Mr. Shaikh for the respondent No. 9 makes a statement that if petitioner is ready to forgo the benefit of the disputed period and is ready to forward fresh copy of Form No. 10-D, his case would be processed in accordance with law. 6.
We direct accordingly. The petitioner shall see to it that he complies with the aforementioned directions as early as possible and the respondent No. 9 shall take the decision after such compliance is made within a period of four (04) weeks thereafter. The writ petition is disposed of.
