Learned Counsel for the petitioner submits that the petitioner was allotted with the sand-spot in auction, however, excavation of sand was not possible because of the circumstances beyond control of the petitioner. The petitioner has applied for refund of amount deposited by the petitioner for allotment of sand-spot. The collector is not paying heed to the same.

Learned Government Pleader waives notice for all the respondents.

In case the application is fled by the petitioner for refund of the amount deposited by him for excavation of sand (page 29), then the Collector, Parbhani shall take decision upon it on its own merits and in accordance with law, preferably within four months.
