By this Writ Petition the petitioner is seeking directions that the caste claim of the petitioner which has been submitted on 26.08.2025 be decided expeditiously.

The learned AGP pointed out that though the petitioner has been appointed on 23.09.2024 from the reserved category and though there is a clause in the appointment order itself that the petitioner is supposed to submit caste validity certificate within six (6) months, the caste claim has been deliberately submitted before the caste scrutiny committee belatedly only in order to gain the benefits. Be that as it may.

Considering the fact that the petitioner is served with copy of proposed action for termination of his service, in peculiar facts and circumstances we direct Respondent -Caste Scrutiny Committee to decide the caste claim of the petitioner within a period of nine months from today.

Since the petitioner is served with copy of notice thereby calling upon the petitioner to submit the caste validity certificate, we deem it appropriate to direct the employer of the petitioner not to take any coercive action against the petitioner for a period of nine months from today.

We, however, deem it appropriate to direct the petitioner to file an undertaking within a period of three weeks before this Court as well as employer stating that the petitioner will not claim any service benefits during the pendency of his caste claim such as promotion, increment, pay fixation and confirmation etc. 6.
