The applicants have moved this application to permit them to withdraw the maintenance amount of Rs. 50,000/- deposited by the respondent in this court, for which the learned advocate for the respondent has opposed.

However, considering the reasons disclosed in the application, as well as the fact that said amount is a part of the arrears of maintenance amount and not the entire maintenance amount. In such circumstances, in my view, it would be appropriate to permit the applicants to withdraw the said amount, as it is required for the school fees of the applicant No. 2.

In view of the above, the application is allowed as prayed for. The applicants are permitted to withdraw Rs. 50,000/-. The Registrar (J) of this court is directed to transmit the said amount to the bank account of the applicant No. 1 within six weeks upon her furnishing the bank account details to the Registry. WRIT PETITION NO.1388/2025 1.

The petitioner is directed to deposit the arrears of maintenance amount, if any, pending till this date in this court, failing which, a necessary order will be passed. 2.

Having considered the nature of the dispute, in my view, this case deserves to be referred to Mediation to resolve the dispute between the parties. Hence, at the request of the learned advocates for both parties, the matter is referred to the Mediation Centre to explore the possibility of settling the dispute. 3.

The parties have suggested for appointing 'Ms. Anagha V. Rote', a learned advocate, as a Mediator by consent. As such, the Coordinator of the Subcommittee is requested to appoint 'Ms. Anagha V. Rote as a Mediator to resolve the dispute between the parties. 4.

The parties are directed to appear before the Mediator at the Mediation Centre on 19-12-2025 at 11.00 am. [ABHAY J. MANTRI, J. ] VishalK/907criapln4553.25.odt
