We have heard learned counsel for the parties. 2.

It appears that on the open space which is handed over to the Grampanchayat, Sangavi Mardi, the Grampanchayat is constructing a water tank which is not on more than 10% of the area. However, the petitioner has filed representation before the Collector, Osmanabad (Exh.E Page 23). The collector may consider the said representation on its own merits and pass appropriate orders on it expeditiously, preferably within three months.

Writ petition is disposed of. No costs.
