Heard the learned advocate for the parties.

This application is for transfer of the matrimonial proceeding from the court of learned Judge, Family Court, Satara to the Court of leaned CJSD, Chhatrapati Sambhajinagar. 3.

The application is filed by the wife.

The learned advocate for the applicant submits that

(2) the applicant is a lady who finds it difficult to attend the court at Satara. There is no one to accompany her to attend the court. The applicant is presently residing at Chhatrapati Sambhajinagar. The applicant has also filed two proceedings in the court at Kannad, Dist. Chhatrapati Sambhajinagar. One is under the Domestic Violence Act and another is under Section 498-A of the Cr. P. C. He submits that for the convenience of the parties, the proceeding be transferred in the court at Chhatrapati Sambhajinagar.

The learned advocate for the respondent vehemently opposed the application.

However, considering the fact that the applicant is staying at Kannad, Dist. Chhatrpati Sambhajinagar, it would be proper to transfer the proceeding to the court at CJSD, Chhatrpati Sambhajinagar. The application therefore deserves to be allowed. Hence, the following order:

ORDER

(i) The application stands allowed.

(ii) Proceeding in HMP No. 157/2024 pending before the Court of leaned Judge, Family Court, Satara stands transferred to the Court of learned Civil Judge, Senior Division, Chhatrapati Sambhajinagar.

(iii) After the proceeding is transferred, the learned trial court shall try to dispose of the proceeding as early as possible and preferably within one year from the date of transfer.

(iv) The Trial Court shall give suitable dates considering the dates given in other proceedings. (v) The respondent is at liberty to request the concerned Court for appearing through video conference.

(v)The applicant shall not seek unnecessary adjournments and shall co-operate in speedy disposal of the case.
