ORDER :- Heard learned counsel for applicant - Insurance Company and respondents No.1 to 4 -original claimants.

Learned counsel for respondents No. 1 to 4 objects to condone the delay.

Considering the nature of litigation, it is desirable to award fair opportunity to the applicant- Insurance Company. Therefore, for the reasons stated in the application, civil application for condonation of delay deserves to be allowed. The civil application is allowed in terms of prayer clause 'B'. The delay of 274 days is condoned. The civil application is disposed of accordingly.

First Appeal (Stamp) No. 39240 of 2017 be registered. 5.

Issue notice to the respondents, returnable on 30-11-2018. 6.
