1) When the present matter was taken up for hearing, learned counsel appearing for the parties jointly submitted that the parties to the present lis have amicably settled the dispute amongst themselves and they have also settled the terms of compromise. The learned counsel for the parties have prayed for disposing of the present appeal in terms of the compromise. The parties to the terms of compromise are present before the court also.
2) The parties were directed to appear
before the learned Registrar of this Court to verify the terms of compromise. Accordingly, the parties appeared before the learned Registrar and the learned Registrar has submitted a written report in that regard. The report reveals that the consent terms are verified by the parties. The terms of compromise are taken on record and marked as "X" for identification 3) The terms of compromise appear to be within four corners of law. Therefore, there may not be any difficulty to allow the parties to have compromise.
4) In view of the above, following order is passed, -
ORDER
i) Second Appeal No.72/2017 stands disposed of in terms of the compromise arrived at between the parties with no order as to costs;
ii) Pending civil application, if any, stands disposed of;
iii) The terms of compromise shall
form part of the decree;
