The application is filed seeking permission to bring the legal representatives of deceased respondent No. 3 on record for the reasons set out in detail in the application.

Heard learned counsel for applicant/appellant. 3.

On due consideration of submissions advanced in the light of facts stated in the application and the cause of action survives to prosecute the application, I am of the view the application deserves to be allowed. Accordingly, the application is allowed in terms of prayer clause 'B' and 'C'. Necessary substitution be carried out within four weeks.
