PER COURT:- 1.

The learned A.G.P. on instructions submits that the proposal for verification of the tribe claim is pending with the committee at the stage of vigilance.

Mr. Rakhunde, learned counsel for the petitioner submits that the proposal has been submitted by the management for approval to the appointment of the petitioner from ST category after completing three years as Shikshan Sevak, the same is not yet decided.

Considering the above we pass the following order:

ORDER

(i) The committee shall decide the validation proceeding in respect of the Tribe claim of the petitioner expeditiously, preferably within a period of six weeks from the date of appearance of the petitioner. The petitioner shall appear before the committee on 30.04.2019.

(ii) The respondent no.2 shall decide the proposal sent to it for the approval to the appointment of the petitioner as an Assistant Teacher and for release of salary on its own merits, in accordance with law and the same would be subject to the decision given by the Scrutiny Committee in the tribe validation proceeding of the petitioner. The decision shall be taken by the Education Officer within a period of three months.

Writ Petition accordingly disposed of. No costs.
