CORAM :

SMT. VIBHA KANKANWADI & SANJAY A. DESHMUKH, JJ.

DATE :

06th August, 2025.

Per Court :

.

The petitioner in this case is the original petitioner in Criminal Writ Petition No.746 of 2022 filed before this Court, wherein

directions were given to register the crime. Thereafter, the FIR vide C.R. No.386 of 2022 came to be registered.

Now, in this petition, it is stated that this Court should monitor the investigation and issue directions to the investigating officer to submit progress reports from time to time, till filing of chargesheet. In fact, as per the letter "Exhibit-X", the learned Public Prosecutor states that for about seven times, the charge-sheet and supplementary charge-sheets have been filed from time to time and as per this letter "Exhibit-X", it is stated that for other accused, a closure report under Section 169 of Cr.P.C. has been filed. Now, the learned Public Prosecutor also places on record the certified copy of the Roznama in Special Case No.87 of 2025 and it appears that as and when the supplementary charge-sheets were filed, separate special case number has been given, but they are all in respect of C.R. No.386 of 2022.

As per the Roznama, on 31st July, 2025, the learned Special Judge under the P.C. Act has issued notice to the informant. Therefore, taking into consideration the further proceedings would be taken up by the learned Special Court, in view of the closure report under Section 169 of Cr.P.C., the learned counsel for the petitioner seeks withdrawal of the petition and he submits that the petitioner would appear before the learned Special Judge.

In view of the above, Criminal Writ Petition No.1741 of 2023 stands disposed of. So also, Criminal Application No.1312 of 2024 would stand disposed of, in view of disposal of the main writ petition.
