The preliminary objection is that the petitioner has a efficacious remedy before the learned Maharashtra Administrative Tribunal (in short 'MAT'). However learned counsel for the petitioner seeks leave to amend the petition and then transfer the same. 2.

We are of the view that even if amendment is made that may be done before the MAT. Prima facie we are satisfied that issue does not fall under the writ jurisdiction. Hence the Registry is directed to transfer this petition to the learned Maharashtra Administrative Tribunal, Aurangabad.

The petitioner is at liberty to press Civil Application for
