IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 913 WRIT PETITION NO. 509 OF 2024 PATHAN MOHAMMAD KHAN CHAND KHAN
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND AND OTHERS ...
Advocate for the Petitioner : Mr. Nagarsoge Sahebrao A. AGP for Respondents/State : Mr. S.K. Tambe ...
CORAM : RAVINDRA V. GHUGE & Y.G. KHOBRAGADE, JJ.
DATE :
17th January, 2024 P.C. :- 1.
The Petitioner is embroiled in the TET exam result scam. He has approached this Court in Writ Petition No.12206/2022. By order dated 05.12.2022, limited interim protection has been granted considering that the Petitioners claim that they are Assistant Teachers or Clerks. The Petitioner is one of those who has got the limited relief. In the said order dated 05.12.2022, we have recorded that no further service benefits would be available. In matters where candidates who have passed their C-TET after the cut-off date 30.03.2019, we have granted limited protection to the extent of the salary to be paid through the grants, if the institution is aided by such grants.
( 2 ) 913 wp 509.24 2.
In view of the above, we would not grant any further relief to the Petitioner who is working as Shikshan Sevak. Departmental enquiries and criminal proceedings have been initiated in several cases. Nevertheless, we would direct Respondent No.7 to clear the outstanding remuneration of the Petitioner, keeping in view that prior to his purported involvement in the TET exam result scam, his service was already approved. Let such arrears be paid within 45 days.

In view of the above observations and directions, this petition is disposed off.
