Irrespective of any other issue, the direction of this Court in the earlier round, whereby the petitioner's request/representation for a suitable transfer was rejected not by the Chief Executive Officer of the Zilla Parishad but by the Education Officer (Primary), on the ground that the petitioner was transferred to the post as per his request in the general transfer. His appeal has been refused to be entertained by the office of the Commissioner by the impugned communication which bears signature of Deputy Commissioner (Establishment).

The writ petition is disposed of directing respondent no. 3-Chief Executive Officer himself to consider the petitioner's representation once again and if possible at the time of upcoming general transfer. ( PRAFULLA S. KHUBALKAR J.) (MANGESH S. PATIL, J.) mkd/- 1/1
