We have heard Shri. More, the learned counsel for the petitioner and Mrs Gondhalekar, the learned Asst. Government Pleader for State.

The petitioner has already filed an appeal before the Collector, Osmanabad, with regard to the same subject matter. The petitioner can make an appropriate application in the pending appeal.

If an application is made by the petitioner, the authority where the appeal is pending, shall consider the same and pass appropriate orders on its own merits expeditiously, preferably within one month from the date of application.
