Heard the learned counsel for the applicant and the learned APP for the respondents-State.

The applicant is apprehending arrest in connection with Crime No. 195/2023 dated 24.6.2023 registered with Kranti Chowk Police Station, Aurangabad City, District Aurangabad for the offences punishable under sections 380, 454 r/w. 34 of I.P.C.

This Court by order dated 1.12.2023 has granted interim protection to the applicant considering the submissions made in para No. 3, as under :- "3.
Learned counsel for applicant submits that the learned Additional Sessions Judge by relying upon statement of the co-accused has rejected application for anticipatory bail. Statement made by learned counsel for the applicant is accepted. In view of this, liberty of the applicant deserves to be protected. Hence, the following order :-"

The learned counsel for the applicant submits that in pursuance of the interim order of this Court, the applicant has attended the police station and has cooperated with investigation. The learned counsel submits that the
ABA 1977/23 chargesheet in the matter is also filed.

Considering the nature of offence, so also interim protection granted by this Court vide order dated 1.12.2023 and considering that the chargesheet in the matter is filed and applicant has cooperated with the investigation, I hold that further custodial interrogation of the applicant is not necessary.

In view of the above, the application is allowed and the interim protection granted on 1.12.2023 is confirmed on the following terms : i] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. ii] The applicant shall co-operate in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 8.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
