Vide order dated 29.09.2025, this Court has permitted the appellant to withdraw the First Appeal at his risk. This Court also permitted for refund of the Court fees as is permissible by law.

Mr. S. K. Shinde, learned Advocate would submit that inadvertently he missed to seek withdrawal of the statutory deposit made by the appellant in this Court. In view of this,
