We have heard learned counsel for respective parties.

The affidavit is filed by the Circle Officer to the effect that the order passed by the Tahsildar, Ashti, on 18.6.2016 is implemented by opening the use of Government road from land
2 W.P.No.14918/17 S.No.10, situated at village Pimpla, Tq.Ashti, District Beed. Copy of Panchanama dated 9.2.2018 and the report dated 10.2.2018 is filed along with the affidavit.

According to the petitioner, the Government road is not opened and only farce is made. In the Writ jurisdiction, we may not be in a position to arrive at the conclusion.

We direct the Sub-Divisional Officer, Ashti, to look into the said aspect about the clearance of the Government road from land S.No.10 as is averred in the affidavit-in-reply filed by the Circle Officer and if the Government road is still blocked, steps may be taken to clear the same expeditiously.

The Writ Petition is disposed of. No costs.
