VERSUS

NITA PRABHAKAR LONIKAR AND OTHERS ...

Advocate for Petitioners : Mr. Sharad S. Shinde, h/f Mr. V. V. Bhavthankar. ...

CORAM :

V. L. ACHLIYA, J.

DATE :

24th April, 2018.

ORDER:

.

The Petitioners have challenged the order dated 5th October, 2017 passed by the Presiding Officer, School Tribunal, Aurangabad Division, Aurangabad in Appeal No.13 of 2017. Heard the learned counsel for Petitioners. Perused the impugned order.

On due consideration of the submissions advanced in the light of the order passed, I am of the view that the order passed by the Tribunal calls for no interference in exercise of writ jurisdiction under Article 227 of the Constitution of India. The Petitioners are neither the formal nor necessary party to the appeal. Respondent No.1 has filed appeal challenging termination as against the Management. The

929 WP.4143.18.odt Petitioners claim to be the teachers working in same school. In this view, the order passed by the Tribunal is perfectly legal and in absence of perversity and error in exercise of jurisdiction, the order impugned calls for no interference in the petition. The petition is dismissed.
