Heard learned counsel for both sides.

This is an application for withdrawal of amount of compensation deposited in this Court by the insurance company.

Learned counsel appearing for the insurance company opposes the application on the ground that the driver of the offending vehicle was not holding valid license on the date of accident. So also, the documentary evidence produced on record regarding income of the deceased is doubtful.

In view of above, at least the applicants can be permitted to withdraw 60 per cent amount of

ca15324.17 compensation deposited in this Court.

Hence, Civil Application is allowed. The applicants are allowed to withdraw 60 per cent amount of compensation deposited in this Court. Rest of 40 per cent amount be invested in fixed deposit in any nationalized bank initially for a period of two years.

Civil Application is disposed of.
