This application is for restoration of Second Appeal (ST) No. 6100 of 2022. Learned counsel for the applicant submits that second appeal was dismissed before issuance of notice to the respondent. He further contends that for non removal of office objections, the second appeal stands dismissed during Covid-19 pandemic period. He, therefore, seeks condonation of delay in restoration of the appeal. Since no notice was issued to the respondent before dismissal of the second appeal, no notice is required of this application. Hence, notice to respondent stands dispensed with.

Considering the application and also in view of the fact of dismissal of second appeal was done during Covid-19 pandemic period, 902.ca372.25.odt

application stands allowed. Second Appeal (ST) No. 6100 of 2022 stands restored from the filed of this Court.

Learned counsel for the appellant, on instructions, seeks withdrawal of the appeal with further prayer of refund of the court fees. 4.

Appeal is dismissed as withdrawn. Court fees be refunded to the appellant in accordance with the rules.
