After hearing the learned counsel for applicant and the learned APP for the State, when this Court expressed disinclination to grant relief, the learned counsel for applicant, on instructions, seeks leave to withdraw this application.
Leave granted. The application is disposed of as withdrawn. The learned counsel for applicant submits that the hearing of the case may be expedited.
This Court has called reports from all the Principal and Sessions Judges within the jurisdiction of Aurangabad High Court. The Court ceased with the matter i.e. Additional Sessions Judge Kopargaon is conducting five expedited cases as per the directions of this Court and
930 BA.2128.2023.odt one matter as per the directions of the Honourable Supreme Court. Therefore, it would not be proper to give directions to the Trial Court to conduct the case of this applicant as expeditiously as possible. However, the Trial Court is directed that after those six ceases are concluded, the case of this applicant be taken for hearing and decide the same as expeditiously as possible keeping in mind that it is a sessions case. Needless to mention that sessions means, once it is started it shall not be stopped till it is concluded. [ SANJAY A. DESHMUKH, J. ] nga
