Heard learned counsel for applicants; learned counsel for acquiring body and learned AGP for State. 3.

On perusal of the impugned judgment and the grounds of objections raised in exception to the said judgment, I deem it appropriate to pass the following order, -

ORDER

i.

The applicants are permitted to withdraw 50% BDV

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD of the deposited amount on submitting an undertaking to the satisfaction of Registrar of this Court.

ii.

The applicants are further permitted to withdraw 25% of the deposited amount on submitting a solvent surety/security in the like amount to the satisfaction of Registrar of this court.

iii.

The balance 25% of the amount be invested in Fixed Deposit Receipt of any nationalized Bank for the period till disposal of the appeal.

iv.

Both the applications for withdrawal of the amount are disposed of.
