1] Heard learned counsel for the applicants, appellant and the learned APP for the respondent-State.
2] The applicants in ABA No.2178 of 2024 have approached this Court apprehending arrest in connection with Crime No.0769/2024, registered with Hingoli Police Station, District Hingoli, for the offences punishable under sections 115 (2), 118 (1), 309 (4), 351 (2) and 352 r/w. Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023 and the appellant in Criminal Appeal No.1084 of 2024 has approached this Court apprehending arrest in connection with Crime No.0761/2024, registered with City Police Station, Hingoli, District Hingoli, for the offences punishable under sections 109, 118 (2), 296 (b), 3 (5), 308 (2), 309 (4), 351 (3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 (1) (r) (s), 3 (2) (v), 3 (2) (va) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
3] This court by interim order dated 10.01.2025 for the reasons mentioned in the said order granted interim protection to the applicants / appellant in respective matters.
4] The learned counsel for the applicants / appellant submits that the applicants / appellant have attended the concerned police station and cooperated with the investigation. This factual assertion of cooperation is not disputed by the learned APP.
5] In view of the above, the interim protection granted by order dated 10.01.2025 stands confirmed, on the following terms:
i] The applicants / appellant shall attend the police station as and when required by the Investigating Officer.
ii] The applicants / appellant shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicants / appellant shall co-operate with the investigation and also in the proceedings before the trial Court.
6] In the event, the applicants / appellant violate any of the conditions specified in this order, it shall be liable to be cancelled.
7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
8] The application and appeal are disposed of.
