The respondent in the writ petition has preferred this civil application for seeking modification in the order dated 15/10/2018 and for seeking directions.

I have heard the learned Advocates for both the sides.

There is no dispute that the respondent is a driver. Learned Advocate for M.S.R.T.C. fairly submits that M.S.R.T.C. needs drivers and there is no charge against this driver that he has involved himself in an accident or drunken driving. The only charge against him is of absenteeism and if he reports for duties subject to the rights of the parties in this litigation, the M.S.R.T.C. would allow him to join duties.

Learned Advocate for the driver submits that, he will join the duties on 16/12/2019 at 10.00 a.m. at Udgir Depot, District Latur.

In view of the above, this civil application is disposed off and the respondent-driver would join his duties at 10.00 a.m. as stated above.
