In spite of service of notice, none appears for respondent no.1. 3.

By this application, the applicant is seeking to condone the delay of 126 days caused in filing the appeal against the judgment and award dated 03/05/2018, passed by 2nd Civil Judge, Senior Division Jalna, in L.A.R. No.703/2011.

Mr. Humbe, learned Advocate appearing for the applicant invites attention of this Court towards Paragraph No.6 of application and submits that, sufficient cause is made out to condone the delay. 5.

In that view of the matter, the contents of the application are not controverted. Hence, the application is allowed in terms of prayer clause - 'B'

and same is disposed of accordingly.
