Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0746/2024, dated 19/11/2024, registered at Gangakhed Police Station, District Parbhani, for the offences punishable under sections 310 (4), 310

(5) of the Bharatiya Nyaya Sanhita, 2023, and under Section 4 read with 25 of the Arms Act.

This Court, by order dated 24/12/2024, granted interim protection to the applicant. It is the case of the informant that the applicant, along with other co-accused, was making preparations for dacoity. It is also stated that a Scorpio vehicle was found parked, in which six weapons were discovered (two swords and four axes). The informant further claims that near the Scorpio vehicle, a motorcycle owned by the brother of the applicant was also parked. It is alleged that the applicant and the other 1 of

950 ABA 2183-2024 accused, who were near the vehicles, were preparing for dacoity. 4.

Considering the case of the informant, and the fact that the applicant has attended the police station in pursuance of the order dated 24/12/2024 granting interim protection, and given that no offence has been committed, the interim protection granted to the applicant is confirmed.

In view of the above, the application is allowed in the following terms : - i] In the event the applicant is arrested in connection with FIR No.0746/2024, dated 19/11/2024, registered at Gangakhed Police Station, District Parbhani, for the offences punishable under sections 310 (4), 310 (5) of the Bharatiya Nyaya Sanhita, 2023, and under Section 4 read with 25 of the Arms Act, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

ii] The applicant shall attend the police station as and when called by the police.

iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. 2 of

950 ABA 2183-2024 iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 6.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 7.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 8.

The application stands disposed of.
