Heard learned counsel for the applicants and the learned APP for the respondent-State.

The applicants are apprehending arrest in connection with FIR No.0305/2024, dated 04/10/2024, registered at Parbhani Rural Police Station, District Parbhani, for the offences punishable under sections 118(1), 115(2), 123, 189, 191, 190, 296, 352 of Bharatiya Nyaya Sanhita, 2023.

This Court, by order dated 24/12/2024, granted interim protection to the applicants. The learned APP has produced the police papers today, in which the statement of witness Gopal Sakharamji Mete discloses that on the relevant day, i.e., on 28/09/2024, there was a scuffle between the applicants and the informant on the road, during which they were abusing 1 of
951 ABA 2188-2024 each other and fighting with kicks and fists. However, it is mentioned in the statement that there was no administration of any liquid to anybody. Additionally, the statement of independent witness Laxman Rustum Kale points out that no liquid was administered to Mangal. It is also noted that Mangal was taken to the hospital. The injury certificate of Mangal shows simple injuries on the back and left knee joint. There is no external injury shown on the face. The certificate further states that after admission to the hospital, the patient was stable and discharged after three to four days. However, there is no medical report indicating any symptoms of poison consumption.

Considering the police papers, the interim protection granted by this Court on 24/12/2024 stands confirmed.

In view of the above, the application is allowed in the following terms : - i] In the event the applicants are arrested in connection with FIR No.0305/2024, dated 04/10/2024, registered at Parbhani Rural Police Station, District Parbhani, for the offences punishable under sections 118(1), 115(2), 123, 189, 191, 190, 296, 352 of Bharatiya Nyaya Sanhita, 2023, they shall be released on bail on furnishing PR bond of Rs.20,000/- each with one or two sureties in the like amount to the satisfaction of the trial Court. 2 of
951 ABA 2188-2024 ii] The applicants shall attend the police station as and when called by the police.
iii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court. 6.
In the event, the applicants violates any of the conditions specified in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 8.
The application stands disposed of.
