After hearing learned counsel for both sides for substantial time and when this Court has shown prima facie inclination to cause interference in the order, learned counsel for the contesting respondent, on instructions, makes statement that contesting respondent/original counter plaintiff desires to withdraw application Exhibit 171 in Special Civil Suit No. 15/2018 with liberty to file application for amendment to the counter plaint.

In view of above statement, order impugned stands set aside. Special Civil Suit No. 15/2018 stands restored. Counter plaintiff is permitted to file application for amendment counter plaint. Trial Court to decide the said application on its own merit. Petition stands allowed in above terms. Consequentially, fresh civil suit bearing No. 217/2023 stands disposed of.
