Mr. Shaikh, the learned Counsel submits that while dismissing the Writ Petition of the present applicant seeking appointment on compassionate ground, the Court has not considered Clause 7 (b) of the Government Resolution dated 29.10.1994 in its correct perspective. Mother of the petitioner was receiving meager salary and she is getting meager pension. It is not possible to maintain the family in such meager sum. The scheme of appointment on compassionate ground is a benefcial scheme. The same will have to be considered liberally. All these facts were not considered by the Court while dismissing the Writ Petition. Reliance is placed on the judgment in the case of BCCI, India

We have heard the submissions.

The purpose of giving appointment on compassionate ground is to provide immediate succor to the family of the deceased dying in harness. Father of the petitioner died in the year 2006. At the time when father of the petitioner died, the mother of the petitioner was in service of Zilla Parishad, Ahmednagar and was in service for two years after his death. Thereafter she is getting family pension. We had considered the fact that at the time of death of the father of petitioner, the mother of petitioner was in service and the source of livelihood existed. 4.
