Heard learned counsel for the applicant - Insurance company. Despite service of notice, no one else appeared on behalf of respondents No. 1 to 3.

Present application is filed for condonation of 113 days delay caused in filing the appeal against impugned judgment and award dated 29-04-2017, passed by the Motor Accident Claims Tribunal, Nandurbar in MACP No.41 of 2014.

For the reasons stated in the application, the same is allowed in terms of prayer clause "B". The delay caused in filing appeal against the impugned judgment and award is hereby condoned. The Registry to take requisite steps for further process. The civil application is disposed of accordingly. 4.

Issue notice to respondents, returnable on 17th July, 2018. 5.
