The applicant, by this application, seeks relaxation of bail condition imposed by this Court vide order dated 26.11.2020 passed in Criminal Application No. 1660 of 2020 regarding attendance to the concerned Police Station.

We have heard the learned advocate for the applicant and the learned APP for the State.

The applicant has preferred an Appeal challenging the Judgment and Order passed by the learned Sessions Judge, Latur in Sessions Case No. 96/2014 thereby convicting him. The Appeal is already admitted. The bail order by which condition has been imposed

2 907APPLN4306.2023.odt by this Court on the Applicant is passed way back in the year 2020. It is nowhere the case of the State that the Applicant has breached any of the conditions imposed upon him. The learned advocate for the Applicant submits that the Applicant has scrupulously followed the conditions imposed upon him. It appears that the Applicant runs a business. In this view of the matter, we proceed to pass the following order.

ORDER

[i] The Application is allowed.

[ii] The condition imposed upon the applicant 'to attend the Ausa Police Station, Ausa, District Latur, on every Monday and Saturday during 01:00 p.m. to 04:00 p.m. till the Appeal is finally decided' is hereby relaxed. [iii] Rest of the conditions to remain as they are. [iv] The Applicant/Appellant shall cooperate in early disposal of the Appeal.
