Heard Shri Choudhari, learned Counsel for the applicant and Shri Raje, learned Counsel appearing for respondent no.2 - Insurance Company. Perused the impugned Judgment and Award. In view of the submissions made, the following order is passed.

ORDER

(i) The application is partly allowed.

(ii) The applicant is permitted to withdraw 60% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar of this Court.

(iii) Balance 40% amount be invested in Fixed Deposit Receipt in any Nationalized Bank for the period till disposal of the appeal.
