PER COURT :- Heard Mr. K.M. Nagarkar learned counsel for the applicant and Mr. S.G. Chapalgaonkar learned counsel for the respondent insurance company. Perused the impugned Judgment and the grounds of objections raised in exception to the said Judgment. In view of the above, following order is passed:-

ORDER

(I) The applicant is permitted to withdraw 50% of the deposited amount on submitting undertaking to the satisfaction of the Registrar of this Court. Balance 50% of the amount be invested in FDR in any nationalized bank for a period till disposal of the appeal. (II) Civil application is disposed of.
