4.1.2018 PER COURT:- 1) Mr.A.M.Phule, learned AGP, who appears for the Superintendent of Police/Respondent No.2 makes a statement that the interest component will be deposited in this Court within a period of four weeks from today. This statement is accepted. In any case, the Respondent No.2 is directed to deposit the interest component within four weeks from today, failing which the interim order granted by this Court shall stand vacated. It is pertinent to note that on 26.7.2017, the learned AGP had
( 2 ) prayed for four weeks time to deposit amount of interest and costs and accordingly the matter was stood over to 23.8.2017.
2) From out of the amount deposited, the applicants are permitted to withdraw the sum of amount Rs.14,00,000/-. Out of this amount, an amount of Rs.1,00,000/- each shall be paid to the applicant Nos.5 and 6 i.e. Mr.Surupsing Fattu Valvi and Mrs.Kamalbai Surupsing Valvi, who are the parents of the deceased, who died in the accident. The balance amount of Rs.12,00,000/- shall be paid in equal proportions to applicant Nos.1, 2, 3 and 4. Since, the applicant No.4 is a minor, his amount of Rs.3,00,000/- shall be kept in Fixed Deposit by the applicant No.1 in the name of applicant No.4 and herself. The applicant No.4 should be given the amount upon attaining majority. 3) The Registry to do the needful.
4) Civil Application is disposed of in the aforesaid terms.
