Both the appeals are preferred by the insurance company. Learned counsel Shri Chapalgaonkar for the appellant is present. None present for the respondents.

Learned counsel Shri Chapalgaonkar for the appellant makes a statement that some amount is deposited with this Court and 60% of the deposited amount has already been withdrawn by the respondents-claimants and the remaining amount is lying with this Court. Learned counsel Shri Chapalgaonkar further makes a statement that the appellant do

-2not desire to continue with the present appeals and wants to withdraw both the appeals. He has filed the pursis to that effect in both the appeals, which are marked as "X". 3.

Since the appellant wants to withdraw the appeals, the respondents shall not suffer any prejudice or hardship. Hence the following order is passed:-

O R D E R

(I) Both the appeals are disposed of as withdrawn. (II) The amount deposited by the appellant - insurance company in both the appeals along-with the accrued interest lying with this Court, shall be transmitted to the learned M.A.C.T., Jalna.

(III) The learned Member, M.A.C.T., Jalna shall disburse the amount as per the law to the claimants - respondents by issuing notices to them.

(IV) The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959.

-3- (V) The pending Civil Applications, if any, are also disposed of.
