The Acquiring Body has deposited an amount of Rs.74,61,975/- towards rental compensation in respect of land Gut No. 22, ad mesuaring 42 Are situated at Shahnoorwadi, Chhatrapati Sambhaji Nagar, which was originally owned and possessed by Fundabai Gangaram Pardeshi. Fundabai had filed LAR No. 291 of 2007. During pendency of the said proceedings, Fundabai expired. Tikaram s/o Laxman Pardeshi was brought on record as legal heir of Fundabai. On his death, Rajendra Sadashiv Shresth, being his will holder, filed Contempt Petition

{2} No. 450 of 2017 in this Court. In the said Contempt Petition, the above mentioned amount is deposited on 9th February, 2018. 2.

Respondents No. 5 and 6 Shobha Ishwarlal Pardeshi and Shama Laxman Pardeshi, daughters of Tikaram Pardeshi, raised objection before the SLAO, staking their claim for entitlement to the compensation amount. The amount, therefore, could not be disbursed.

Applicant Rajendra and Respondents No. 5 and 6 have preferred this joint Application contending that they have settled the matter amicably and they have decided that 50% of the deposited amount shall be given to Applicant Rajendra and remaining 50% be given to both the daughters of Tikaram i.e. 25% each.

The settlement terms are verified before the learned Registrar (Judicial). Both the parties are present in the Court. They are identified by their respective learned Advocates. They confirm the settlement terms.

Upon hearing the learned Advocate for the Applicant, learned Advocate for the Respondents No.5 and 6 and learned AGP, we pass the following order:

ORDER

I) Applicant Rajendra be paid 50% of the deposited amount of rental compensation along with proportionate interest accrued thereon.

II) Respondents No. 5 Shobhabai Ishwarlal Pardeshi and Respondent No. 6 Shama Laxman Pardeshi each be paid 25% of the deposited amount of rental compensation along with proportionate interest accrued thereon.
