IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 947 CIVIL APPLICATION NO.5520 OF 2022 IN FAST/38434/2019 WITH CA/5522/2022 IN FAST/38563/2019 SUSHILABAI CHANDARRAO HADULE

VERSUS

STATE OF MAHARASHTRA THR THE COLLECTOR, OSMANABAD AND OTHERS ...

Mr. V.V. Ingle, Advocate for the applicant.

Mr. S.R. Yadav-Lonikar, A.G.P. for respondent Nos.1 and 2. ...

CORAM :

SANDIPKUMAR C. MORE, J.

DATED :

23.11.2022.

ORDER:- 1.

Heard rival submissions. The respective applicants in all these applications are seeking condonation of delay periods as mentioned therein. The delay appears to be caused due to their financial crisis. The learned A.G.P. strongly opposed the application on the ground that there is also circulation delay. The Acquiring Body though served, but remained absent. However, considering the statutory right of the applicants, the delay periods as mentioned in these applications stand condoned subject to condition that the applicants shall not claim any interest for the aforesaid delay periods and also for the delay in circulating matters belatedly.

(2) 947 CA-5520.2022.odt 2.

The appeals be placed for admission after removal of office objections.

3.

The Civil Applications are disposed of accordingly. (SANDIPKUMAR C. MORE, J.) vd_dhirde
