The learned counsel for Respondent No.4 on specific instructions from the Commissioner submits that Respondent No.4 / Municipal Commissioner, Municipal Corporation, Latur is withdrawing the order dated 22nd July, 2014, which is impugned in this writ petition with liberty to inquire into the matter afresh and after hearing, take appropriate decision in the matter.

In view of the above, if the order impugned in this writ petition is going to be withdrawn, then nothing survives in this writ petition for adjudication. The writ petition is also disposed of with the following directions:

The Petitioner shall appear before Respondent No.4 / Municipal Commissioner, Municipal Corporation, Latur on 20th February, 2018 and after giving an opportunity of being heard to the Petitioner, the Commissioner shall pass the appropriate order in the pending issue afresh within a period of one month form the date of appearance of the Petitioner before the learned Commissioner.
