Heard the learned advocate for the petitioner, learned A.G.P. and learned advocate Mr. Patil who appears for the respondent nos. 2 and 3. 2.

The petitioner is to blame himself for the situation he is in. He has missed the deadline for submission of the examination form not only before the cut-off date but even the extended cut-off date by making payment of additional late fees which expired on 28.11.2023. 3.

Since the petitioner is intending to appear for the fourth year of BUMS course examination which is to commence from 19.12.2023 and taking into account the schedule published by the respondent-university inter alia notifying that the admit cards/hall tickets and the list of students college wise will be uploaded on the university website preferably prior to commencement of the theory examination, particularly when the notification also takes care by putting a note that with the directions of the Court the University can accept late submission of the applications with additional late fees, we see no reason why the University cannot permit the 1/2

913 WP 14853 23.odt petitioner to fill in the examination form with the late fees prescribed when the examination process is still under way and there is apparently no practical difficulty even if he is permitted to submit the examination form now.

We allow the writ petition and direct the respondents to permit the petitioner to fill in examination form provided he does it on or before 07.12.2023. The respondent no. 4-college shall take necessary steps. ( NEERAJ P. DHOTE, J.) (MANGESH S. PATIL, J.) mkd/- 2/2
