Present application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashment of the proceedings in Regular Criminal Case No.2516/2024 pending before learned Judicial Magistrate First Class, Aurangabad, arising out of First Information Report vide Crime No.174/2024 dated 19.06.2024 registered with Police Station, Harsul, Tq. & Dist. Chhatrapati Sambhajinagar, for the offence punishable under Sections 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860.

The parties have compromised the matter. The compromise pursis, which is containing the terms, has been produced on record. Terms of compromise have been got verified through Registrar (Judicial) and learned

1076_Cri.Appln_4655_2025_Compromise Registrar (Judicial) has submitted his report dated 15.12.2025. As per the said terms of settlement, respondent No.2 and applicant No.1 have decided to bury the differences and respondent No.2 - informant has given no objection for quashment of the proceedings. Since the dispute that arose was matrimonial dispute and now the parties i.e. applicant No.1 and respondent No.2 have decided to part, there is no hurdle in allowing the application. Hence, following order.

ORDER

i) Criminal Application stands allowed.

ii) The proceedings in Regular Criminal Case No.2516/2024 pending before learned Judicial Magistrate First Class, Aurangabad, arising out of First Information Report vide Crime No.174/2024 dated 19.06.2024 registered with Police Station, Harsul, Tq. & Dist. Chhatrapati Sambhajinagar, for the offence punishable under Sections 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860, stands quashed and set aside as against applicants viz. 1) Mrugank Madhukar Saindane, 2) Nirmalabai wd/o Madhukar Saindane and 3) Shyamkumar Madhukar Saindane.
