Mr. Nagargoje, learned counsel submits that Hiwari (Thakurwadi) tank is within the jurisdiction of the petitioner society. The auction is scheduled of the said tank for fishery purpose and the last date for filing application is 13.12.2019. The petitioner has submitted applications on 15.11.2019, 03.12.2019 and 04.12.2019 to delete the said tank from auction proceedings, as petitioner is only entitled for the said tank for fishing purposes. However, the respondent No. 2 has not taken cognizance of the same.

In case, applications filed by the petitioner (page no. 41, 42 &

45) are pending with respondent no. 2 for deletion of the said tank

2 20-WP14847-19.odt from auction proceedings, then respondent no. 2 shall decide the said applications on its own merits, simultaneously with the tender proceedings.
